Cleveland County does not define the term "proper" as it relates to shelter and as such we must look to other sources as a means of developing a standard.  After reviewing NC General Statutes, it was determined that a standard for housing has also not been defined. 
A standard was found in NC Administrative Code under the NC Dept. of Agriculture and Consumer Services.  The standard states: "Dogs and cats kept outdoors shall be provided housing to allow them to remain dry and comfortable during inclement weather.  Housing shall be constructed of material which is impervious to moisture and which can be disinfected.  One house shall be available for each animal within each enclosure except for a mother and its unweaned offspring." Until the ordinance is re-written we must look to standards developed by other government entities. Please revisit the property in question and make another review of the shelter.
